Tabatwo ApS (CVR 45372898) is a Danish company focused on promoting health and well-being through social fitness experiences. We are committed to protecting your privacy and ensuring that your personal data is handled transparently and securely in accordance with the EU General Data Protection Regulation (GDPR) and applicable Danish data protection laws.

Note on HIPAA:

Tabatwo is a fitness and wellness platform. We do not collect, store, or process medical records or clinical health information as defined under HIPAA (U.S. Health Insurance Portability and Accountability Act). Our platform is not intended for medical or clinical use.

2. The Data We Collect

We collect personal data when you create a user or instructor account, use features such as workouts, peer invites, chats, groups, or video sessions, book or host sessions, make payments through our platform, or contact us via email or in-app support.

This may include your name, email address, country of residence, gender, age, and language (optional), fitness preferences, goals, selected training styles, device and usage information (such as language settings, browser type, session duration, and app version), and payment details (processed securely via Stripe – we do not store full card numbers).

For instructors, we also process business name, CVR number (for Danish instructors), professional certifications, pricing, bank details for payouts, and profile content uploaded to the platform.

Tabatwo is intended for adults aged 18 years or older. Individuals under 18 are not permitted to create an account or use the Service.

3. Why We Collect It

We process your personal data to create and manage your account, deliver the services and features you request, enable safe communication between users and instructors, process payments and refunds, personalize your experience, improve reliability and security, and prevent abuse or fraud.

For instructors, data is also used to display professional profiles, handle subscriptions, and process session payments.

4. Legal Basis for Processing

We process your data based on one or more of the following legal bases: consent (when you provide data voluntarily or agree to marketing preferences), contractual necessity (to deliver requested services such as bookings and payments), legitimate interests (to maintain platform security and improve the user experience), and legal obligations (to comply with accounting or tax laws).

5. How We Share Data

We only share personal data when necessary to deliver and maintain our Service. This includes payment processors (Stripe), hosting and analytics providers (Firebase and Google), and communication tools used for support and notifications.

Some data may be processed outside the EU/EEA. When this occurs, Tabatwo ensures adequate protection through EU Standard Contractual Clauses (SCCs) or other GDPR-approved mechanisms.

When you engage with chats, groups, or community spaces, information you share – such as messages or participation details – may be visible to other users. Please share responsibly and avoid disclosing sensitive information.

We do not sell or rent your personal data.

6. Cookies, Analytics, and AI-Based Features

Tabatwo uses cookies and similar technologies to remember your login and preferences, measure engagement, and analyze performance. We use a cookie consent mechanism to obtain your consent for non-essential cookies in accordance with GDPR and ePrivacy regulations.

Tabatwo may use anonymized or aggregated data to analyze usage trends, improve platform functionality, enhance social features, and develop new services. This data cannot be used to identify individual users.

AI-Powered Personalization:

Tabatwo may use third-party AI services to provide personalized recommendations, reminders, and motivation prompts based on your activity and engagement history. When available, this feature will require your explicit consent, which you can manage in your account settings. Data shared with AI providers will be pseudonymized but may be linked to your account to enable personalization. You may withdraw consent at any time without affecting your access to other platform features.

7. Data Retention

We retain personal data only for as long as necessary to fulfill the purposes described in this Privacy Policy. You may request deletion of your account and related data by contacting hello@tabatwo.com. Certain records may be retained to comply with Danish legal obligations such as tax and accounting requirements.

Chat messages and group communications are retained until you delete your account or request deletion of specific data.

Tabatwo may retain anonymized or aggregated data, such as usage metrics or statistical trends, for analytical, research, or product development purposes after account deletion. This data cannot be used to identify you.

8. Your Rights (Under GDPR)

You have the right to access, correct, or delete your personal data, restrict or object to processing, and withdraw consent where applicable. Requests can be made by emailing hello@tabatwo.com, and we will respond within 30 days.

9. Data Security

We use appropriate technical and organizational measures such as encryption, secure servers, and restricted access to protect your data. While we take strong precautions, no online system is entirely without risk. Please use strong passwords and keep your credentials private.

10. Changes to This Policy

We may update this Privacy Policy from time to time. When significant changes occur, we will notify you via email or through the app. The most recent version will always be available in the app and on our website, with the effective date shown above.

11. Relationship to Terms & Conditions

Your use of the Tabatwo platform is also governed by our Terms & Conditions, available at www.tabatwo.com/terms-conditions. In the event of any conflict between this Privacy Policy and the Terms & Conditions regarding data handling, this Privacy Policy shall prevail.
